New Jersey Passes New Alimony Law

On September 10, 2014, New Jersey passed new legislation regarding alimony.

Significant changes include the elimination of permanent alimony.  The forms of alimony currently available to parties seeking a divorce include open durational alimony, rehabilitative alimony, limited duration alimony or reimbursement alimony.

The new law further provides that alimony shall not exceed the length of the marriage or civil union where the marriage or civil union was less than 20 years.

Also, alimony may be either modified or terminated when the paying spouse is eligible to receive full retirement benefits under the Social Security Act.

Lastly, alimony may be suspended or terminated if its recipient cohabits with another person and the couple engages in joint responsibilities for the household including but not limited to finances, living expenses, chores, etc. and share a personal relationship, social and family circle.
